Privacy Policy

1. Application

This privacy policy applies to Vertex Technologies Pty Ltd ACN 611 787 029 (Vertex, we, our, or us) and its related bodies corporate, and including where Vertex trades under any business name registered to Vertex.

2. We respect your privacy

Vertex respects your right to privacy and is committed to safeguarding the privacy of our customers, website visitors and other people with whom we interact. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (Privacy Act).

This privacy policy sets out how:

  • Vertex protects the privacy of personal information it collects;
  • Vertex may use such information and to whom such information may be disclosed; and
  • individuals can access and correct the personal information Vertex holds, lodge complaints with Vertex in respect of alleged breaches of privacy or make any related enquiry.

By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.

“Personal information” is information or an opinion about an individual who is reasonably identifiable, whether or not the information or opinion is true or recorded in a material form.  

3. Collection of personal information

Vertex will, from time to time, receive and store personal information which is:

  • entered and submitted onto our website;
  • provided to us directly; or
  • otherwise provided to us in various forms.

Personal information we collect and store may include:

  • basic information such as your name, phone number, address and email address;
  • date of birth, preferred pronouns, details of next of kin or emergency contact, payment details, resumes, employment histories and qualifications, training records and competency assessments, police checks and other suitability checks;
  • other information contained in the following, which are submitted to us or otherwise provided to us:
    • feedback you submit to us;
    • information about your personal and business affairs;
    • job applications or contractor agreements;
    • your content or email preferences;
    • responses to surveys or promotions;
    • the provision of financial or credit card information; and
  • other information you provide to us when you communicate with our customer support.

We may also collect the following information about you when you access our website:

  • the pages viewed and the information downloaded;
  • the IP address of the computer used to visit our website;
  • the page from where the individual visited our website;
  • the type of browser used; and
  • information about websites visited before the individual visited our website,

noting that the information we collect from visits to our website is generally anonymous (unless you specifically complete and submit a form to us using a form we make available to you via our website). We generally do not use such information to identify specific individuals. However, due to the nature of the Internet, such information may contain details which may identify a particular individual.

4. How we collect your personal information

Vertex collects personal information from you using lawful means, in a variety of ways, including without limitation:

  • via a form (either physical or online) that is completed and submitted to us;
  • via a telephone, email or in-person inquiry or discussion about us, the products and/or services that we provide;
  • through mail correspondence, emails and other electronic means (including by accessing our website and the use of the “contact us” form on our website);
  • through publicly available sources of information;
  • from job applicants and staff members;
  • through direct contact in the course of us providing our goods and/or services;
  • in the course of conducting market research, including customer satisfaction surveys;
  • in the course of providing our goods and/or services to our customers; and
  • from current and prospective suppliers of goods and/or services to us.

We may from time to time use cookies on our website. Cookies are files which a website uses to identify you when you come back to the site and to store details about your use of the site. Cookies are not malicious programs that access or damage your computer. Most web browsers automatically accept cookies but you can choose to reject cookies by changing your browser settings. However, this may prevent you from taking full advantage of our website. Our website may from time to time use cookies to analyses website traffic and help us provide a better website visitor experience. In addition, cookies may be used to serve relevant ads to website visitors through third party services such as Google Adwords. These ads may appear on this website or other websites you visit.

In some circumstances, we may receive personal information from third parties. Any such personal information will be subject to this Privacy Policy.

5. Why we collect and how we use personal information

Vertex only uses personal information collected from you for:

  • the primary purpose for which the information was collected; or
  • as otherwise permitted or authorised by law, including without limitation, under the Australian Privacy Principles and the Privacy Act.

For example, personal information may be used to enable us to:

  • provide our services;
  • provide access to Vertex products and platforms;
  • provide you with information and updates;
  • advise you of new and additional products, services and opportunities which are available to you;
  • address queries or resolve complaints;
  • analyse how people use our website and how it may be improved;
  • install, maintain, support and service products we have supplied;
  • process transactions and administer customer accounts (including the processing of bills, invoices, statements of account, etc);
  • initiate contact with an individual if the individual and/or their employer has not purchased products or services from us for an extended period of time, or otherwise has not engaged with us for an extended period of time (unless we are informed that the individual no longer wishes to be contacted by us or by anyone on our behalf);
  • carry on our business as a provider of cyber security solutions and related services;
  • improve our products and services and better understand your needs;
  • directly market our products and services to current or prospective customers; or
  • otherwise, to contact you by telephone, email, text message or by mail.

6. Disclosure of your personal information

Vertex may disclose your personal information to any of its employees, officers, related entities, insurers, professional advisers, agents, suppliers or subcontractors to the extent reasonably necessary to fulfil the purposes set out in section 4 of this Policy. Other circumstances in which we may disclose your personal information include where we consider it necessary or required to:

  • facilitate the delivery of our services;
  • comply with a contractual obligation or legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request;
  • Identify, contact or bring an action against any third party whom Vertex suspects or knows is causing harm to, or interference with the products or services Vertex provides, Vertex’s information technology systems and equipment, or Vertex’s property; or
  • protect the copyright, trademarks, legal rights, intellectual property, property or safety of Vertex, its customers or third parties.

Personal information about individuals which Vertex has collected may be disclosed to third parties in the event its business and/or assets are sold or offered for sale, at or before the time of a merger, acquisition or sale.

When Vertex engages third parties to provide products and/or services to Vertex, such third parties may have access to personal information Vertex holds about individuals. Vertex does not authorise those third parties to use any personal information disclosed to or accessed by the third party for any purpose other than to facilitate the third party’s completion of its obligations owed to Vertex.

Without limiting the foregoing, Vertex may disclose individuals’ personal information to its business partners and advisors (such as auditors, financial services or insurance companies) or to its professional advisers (such as its legal and accounting advisers) for them to complete their obligations owed to Vertex under agreements that Vertex has entered into for the purpose of undertaking or furthering its business operations and activities.

7. Storage of personal information

Personal information collected by Vertex is generally stored by Vertex as electronic data within our information technology systems. From time to time, information that we collect may be stored, processed in or transferred between parties located in countries outside of Australia. These may include, but are not limited to the United Kingdom, New Zealand, the USA, Germany, Ireland, Poland, Singapore and the Philippines.

8. Security of your personal information

Vertex is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access, modification or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

Vertex regularly reviews and updates its physical and data security measures in light of current technologies and the requirements of applicable laws.

Vertex only holds personal information it collects from or about an individual as long as reasonably necessary to fulfil the purpose(s) for which the information was collected, as required by law or in accordance with Vertex’s document retention policies. When the information is no longer required to be held by Vertex then Vertex will take reasonable steps to destroy or de-identify the information.

Vertex’s website may contain links to third parties’ websites. Those other websites are not subject to Vertex’s privacy policies and procedures. You will need to review those websites directly to view a copy of their privacy policies. Vertex does not endorse, approve or recommend the products or services provided by the operators of the relevant third party website, and the fact that Vertex includes links to those third party websites should not be construed as an endorsement, approval or recommendation of either the website operator or the products or services so provided.

9. Access to your personal information

You may request details of personal information about you which is held by us, in accordance with the provisions of the Privacy Act. A reasonable fee may be payable for the provision of information, to cover the costs incurred in providing access to the personal information. If you would like a copy of the personal information which we hold about you or believe that any personal information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact our Privacy Officer using the contact details in section 12. We will provide the requested information to you within 30 days.

We may:

  • refuse to provide you with personal information that we hold about you, where permitted under the Privacy Act;
  • request information from an individual making an access request in order to verify the identity of the individual making the request and ensure that Vertex is not inadvertently making a disclosure of personal information to a person not entitled to that information; and
  • redact information made available in order to protect the privacy of other individuals.

10. Complaints about privacy

If you have any complaints about our privacy practices, please send details of your complaints in writing to our Privacy Officer using the contact details in section 12.  We will acknowledge receipt of your complaint promptly and endeavour to respond within a reasonable time period following receipt.

If you remain dissatisfied with our response to your complaint, please let us know, otherwise you may escalate the complaint to the Office of the Australian Information Commissioner.

11. Changes to Privacy Policy

Please be aware that we may change this Privacy Policy in the future. We may modify this Policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board. Please check back from time to time to review our Privacy Policy.
